Commvault User Group Community Guidelines, Privacy Statement, and Terms of Use

1. Introduction

Welcome to the Commvault User Group (CUG) community. This global program is designed to foster collaboration, knowledge sharing, and professional development among Commvault customers, partners, and data management professionals. 

By accessing, joining, or participating in any Commvault User Group activities, platforms, or events, you agree to comply with this Member Policy, including Community Guidelines, Privacy Practices, and Terms of Use. 

2. Community Code of Conduct

2.1 Professional Conduct 

Members are expected to: 

  • Engage respectfully and constructively 
  • Focus on ideas and shared learning, not individuals 
  • Foster an inclusive and collaborative environment 

2.2 Appropriate Use 

The Commvault User Group is intended for: 

  • Sharing best practices and real-world experiences 
  • Asking questions and providing peer support 
  • Discussing Commvault technologies and related topics 

2.3 Prohibited Activities 

Members may not: 

  • Engage in solicitation, sales, or promotional activity
  • Post defamatory, abusive, offensive, or unlawful content
  • Share confidential, proprietary, or sensitive information
  • Violate intellectual property rights

Commvault reserves the right to suspend or terminate participation for violations of these standards. 

3. Privacy Statement

3.1 Information Collection 

Commvault may collect personal and professional information including: 

  • Name, title, company, and contact details 
  • User profile and participation data 
  • Event registration and attendance information 

3.2 Use of Information 

Information is used to: 

  • Deliver and improve community experiences 
  • Provide relevant communications and updates 
  • Personalize engagement and content 
  • Analyze program effectiveness (in aggregated form) 

3.3 Community Visibility 

Information shared in community platforms (e.g., discussions, shared content) may be visible to other members. Members should avoid sharing sensitive or confidential data. 

3.4 Data Sharing 

Commvault: 

  • Does not sell personal data 
  • May share aggregated, non-identifiable information 
  • May disclose information when required by law or legal process 

3.5 Communications Preferences 

Members may receive: 

  • Program updates and announcements 
  • Event invitations 
  • Optional partner communications (opt-out available) 

Members can manage communication preferences at any time. 

3.6 Cookies and Analytics 

Commvault may use cookies and analytics technologies to improve user experience and understand engagement trends. 

4. Events, Media, and Content

4.1 Event Participation 

Participation in Commvault User Group events is voluntary. Members may control what information they share during event registration or participation. 

4.2 Photography and Recording 

Commvault may capture photos or videos at events for marketing, promotional, and community purposes. Where required, consent will be obtained for identifiable use. 

5. Community Platforms and Content Use

Members agree that: 

  • Content shared may be publicly visible within the community 
  • Posts must comply with applicable laws, including defamation and intellectual property laws 
  • Content must not infringe on third-party rights 

Commvault may remove content that violates these standards. 

6. Security Practices

Commvault implements reasonable administrative, technical, and physical safeguards to protect personal data. However, no system is completely secure, and users share information at their own risk. 

7. Managing Your Information

Members may: 

  • Access, update, or correct their information 
  • Modify communication preferences 
  • Request deletion or deactivation of their data (subject to legal obligations) 
8. Terms of Use

8.1 Acceptance of Terms 

By participating in the Commvault User Group, you agree to these Terms of Use and all applicable laws and regulations. 

8.2 No Warranty 

The community, content, and materials are provided “as is” without warranties of any kind, express or implied, including but not limited to: 

  • Accuracy or completeness of information 
  • Fitness for a particular purpose 
  • Availability or uninterrupted access 
  • 8.3 Limitation of Liability 

To the maximum extent permitted by law, Commvault shall not be liable for any: 

  • Direct, indirect, incidental, or consequential damages 
  • Loss of data, business, or profits 
  • Issues arising from reliance on community content

8.4 Third-Party Content and Links 

The community may include links to third-party sites or content. Commvault is not responsible for the practices, content, or policies of third parties. 

8.5 Intellectual Property 

All Commvault trademarks, logos, and materials are the property of Commvault Systems, Inc. or its licensors. Use of such materials without permission is prohibited. 

8.6 User-Generated Content License 

By submitting content, you grant Commvault a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for community and promotional purposes. 

8.7 Indemnification 

You agree to indemnify and hold harmless Commvault, its affiliates, employees, and partners from any claims, damages, or liabilities arising from your participation or violation of this policy. 

8.8 Termination 

Commvault reserves the right to suspend or terminate access to the community at its sole discretion, without prior notice, for conduct that violates this policy. 

9. Policy Updates

Commvault may update this policy at any time. Updates will be posted with a revised effective date. Continued participation constitutes acceptance of updated terms.

11. Governing Law

This policy shall be governed by and construed in accordance with the laws applicable to Commvault Systems, Inc., without regard to conflict of law principles. 

12. Regional Compliance & Data Protection Addendum

Commvault is committed to complying with applicable global data protection and privacy regulations. The following sections provide additional rights and disclosures for users in specific regions. 

12.1 European Economic Area (EEA), United Kingdom, and Switzerland (GDPR/UK GDPR) 

If you are located in the EEA, UK, or Switzerland: 

Legal Basis for Processing 

We process personal data under one or more of the following legal bases: 

  • Consent 
  • Performance of a contract 
  • Legitimate interests (e.g., improving community experience) 
  • Compliance with legal obligations 

Your Rights 

You have the right to: 

  • Access your personal data 
  • Rectify inaccurate or incomplete data 
  • Request erasure (“right to be forgotten”) 
  • Restrict or object to processing 
  • Data portability 
  • Withdraw consent at any time 

International Data Transfers 

Your data may be transferred to and processed in countries outside your jurisdiction, including the United States. Commvault uses appropriate safeguards such as Standard Contractual Clauses (SCCs) or other lawful transfer mechanisms. 

Data Retention 

We retain personal data only as long as necessary for the purposes described in this policy, unless a longer retention period is required by law. 

Complaints 

You have the right to lodge a complaint with your local data protection authority. 

12.2 United States (CCPA/CPRA – California Residents) 

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA): 

Your Rights 

  • Right to know what personal information is collected and how it is used 
  • Right to request deletion of personal information (subject to legal exceptions) 
  • Right to correct inaccurate personal information 
  • Right to opt out of the sale or sharing of personal information (Commvault does not sell personal data) 
  • Right to non-discrimination for exercising privacy rights 

Sensitive Personal Information 

Commvault does not use sensitive personal information for purposes beyond those permitted by law.

12.3 Canada (PIPEDA) 

For users in Canada: 

  • Personal information is collected, used, and disclosed with consent 
  • Users have the right to access and correct their personal information 
  • Commvault limits collection to what is necessary for identified purposes 

12.4 Asia-Pacific (Including Singapore PDPA, Australia Privacy Act) 

For users in APAC regions: 

  • Personal data is collected for reasonable and disclosed purposes 
  • Consent will be obtained where required 
  • Users may request access or correction of their data 
  • Cross-border transfers are managed in accordance with applicable laws 

12.5 Other Jurisdictions 

Commvault will comply with applicable privacy and data protection laws in all jurisdictions where it operates. Where local laws provide additional rights, Commvault will honor those rights as required.

By participating in the Commvault User Group, you acknowledge that you have read, understood, and agree to this Member Policy.
